South Dakota
In South Dakota, all aspects of the sex trade —whether selling sex, buying sex, promoting it, or profiting from it—are completely illegal. South Dakota has distinct laws for purchasing sexual services (hiring for sexual activity) and selling sexual services (prostitution). A person who is convicted of, or has pled guilty to, one or more violations of “hiring for sexual activity” in the previous ten years is guilty of a Class 6 felony. South Dakota has a trafficking-specific law for criminal record relief, but it only applies to survivors who were minors at the time of their arrests.
