New York
In New York, all aspects of the sex trade —whether selling sex, buying sex, promoting it, or profiting from it—are completely illegal. New York has distinct laws for buying sex (patronizing) and selling (prostitution). In 2021, New York repealed the crime of Loitering for the purpose of prostitution, which was deemed discriminatory in its application. There have been efforts to pass partial decriminalization (Survivor Model) laws in New York in recent years.
New York has passed a very broad and all encompassing record relief statute which does not limit offenses eligible for relief, allowing survivors to vacate criminal records for any offense occuring as a result of being trafficked.
