Illinois
In Illinois, all aspects of the sex trade—whether selling sex, buying sex, promoting it, or profiting from it—are completely illegal. The law has distinct crimes for buying (solicitation) and selling sexual services (prostitution). Illinois allows for vacatur for trafficking survivors but relief only applies to prostitution-related offenses and is narrow in scope. In 2023, Illinois passed HB 3414 (Sara’s Law) which amends the unfair sentencing practices that impact criminalized youth trafficking survivors.
